General Terms and Conditions and Terms of Use for Yemevo
1. Provider and scope
These General Terms and Conditions and Terms of Use (“Terms”) apply to the use of the Yemevo app and the associated digital services.
Unless expressly stated otherwise at the time the respective contract is concluded, the provider and contracting party is:
Monadion GmbH
Schönbrunner Straße 181/1
1120 Vienna
Austria
Managing Director: Ing. Arapsih Güngör, MSc
Register court: Commercial Court of Vienna
Company register number: FN 667594g
VAT ID: ATU82735426
Contact and support:
support@yemevo.com
These Terms apply to both the free and the paid use of Yemevo.
Yemevo is intended exclusively for persons aged 18 and over.
2. What is Yemevo?
Yemevo is a consumer app for general:
- nutrition planning,
- meal planning,
- lifestyle planning,
- wellness features,
- weight tracking,
- lifestyle tracking,
- AI-assisted nutrition suggestions, and
- simulation-based lifestyle estimates.
Depending on the selected plan and the product version available at the time, the following features in particular may be offered:
- personalised meal plans,
- weekly meal plans,
- recipe suggestions,
- calorie and macronutrient information,
- dietary preferences and food restrictions,
- Meal Scan,
- barcode and product information,
- shopping lists,
- weight tracking,
- water and step tracking,
- goals and progress features,
- Metabolic Twin,
- voice-based input features, and
- further lifestyle and nutrition features.
The specific scope of features follows from the description currently provided within the app and, for paid offerings, from the service description shown before the respective subscription is concluded.
3. Not a medical application
Yemevo is a lifestyle, nutrition and meal-planning application.
Yemevo is not intended to
- diagnose diseases,
- treat diseases,
- prevent diseases,
- produce medical prognoses,
- make medical decisions, or
- replace professional medical or nutritional-therapy advice.
The content, calculations, meal plans, simulations and AI output provided by Yemevo are general lifestyle and nutrition suggestions.
In particular, they do not constitute an individual medical diagnosis, therapy, treatment or medical recommendation.
If you have medical complaints or conditions, special health requirements, or any uncertainty, you should consult appropriately qualified medical or nutritional-medicine professionals.
4. Minimum age
Yemevo may only be used by persons who have reached the age of 18.
During registration or onboarding, Yemevo may use the date of birth you provide in order to verify the minimum age.
Users are obliged to provide accurate information about their age.
5. Registration and user account
A personal user account is required in order to use Yemevo's essential features.
Depending on the platform, registration may in particular be carried out via:
- email and password,
- Google Sign-In, or
- Sign in with Apple.
You are obliged to protect your access credentials appropriately against access by third parties.
A user account is personal in principle and may not be transferred to other persons without Yemevo's consent.
If you suspect misuse of your account or unauthorised access, you should inform us as quickly as possible at support@yemevo.com.
6. Accuracy of user information
The quality and personalisation of the content provided by Yemevo depends substantially on the information you provide.
You are therefore responsible for keeping your information accurate and up to date to the best of your knowledge.
This concerns in particular information such as:
- age,
- weight,
- height,
- activity level,
- dietary preferences,
- allergies and intolerances,
- food restrictions,
- calorie targets,
- target weight, and
- other personal settings.
Yemevo cannot guarantee that suitable results will be produced on the basis of inaccurate, incomplete or outdated information.
7. Allergies and intolerances
Yemevo can take into account allergies and intolerances that you provide voluntarily.
Processing this information requires the separate consent necessary for that purpose.
Yemevo uses technical rules and AI instructions in order to take stated allergies and intolerances into account in nutrition suggestions.
Despite these measures, automated systems, AI models, external product databases or food information may contain errors.
In the case of severe allergies or intolerances, Yemevo must therefore not be used as the sole basis for deciding whether a food is safe for you.
Please check in particular:
- ingredient lists,
- allergen labelling,
- manufacturer information, and
- where applicable, advice from medical professionals.
No express assurance is given that a suggested product or recipe is free of allergens under all circumstances.
8. Food restrictions
Yemevo makes it possible to state specific dietary rules and food restrictions.
These may include, for example:
- no pork,
- no alcohol as a food ingredient,
- no shellfish,
- no combination of meat and dairy products.
These settings are treated as food and dietary preferences.
Yemevo does not infer any particular religion or belief of the user from them.
Unless Yemevo expressly offers a certification or a specific feature for this purpose, taking individual food restrictions into account does not automatically mean that a meal plan or food is fully certified according to particular religious standards.
9. AI-assisted features
Yemevo uses artificial intelligence for certain features.
These may include in particular:
- meal plan generation,
- recipe generation,
- Meal Scan,
- shopping list support,
- Metabolic Twin,
- voice interpretation, and
- further features labelled accordingly.
AI-generated content may contain errors, inaccuracies or incomplete information.
Where provided for, Yemevo labels such content, for example with:
- “Created with AI”,
- “AI estimate”, or
- “Estimated development”.
There is no entitlement to AI-generated results being identically reproducible.
10. Meal plans and nutrition suggestions
Meal plans are created on the basis of your settings and the information technically available.
In doing so, Yemevo may take into account, among other things:
- your calorie target,
- meal frequency,
- desired preparation time,
- dietary restrictions,
- allergies and intolerances,
- preferred cuisines,
- favourite and rejected foods,
- meal-prep preferences, and
- other planning priorities.
Meal plans constitute suggestions.
In particular, Yemevo does not guarantee:
- any particular weight loss,
- any particular weight gain,
- the achievement of a target weight by a particular point in time,
- any particular physical changes, or
- any particular health outcomes.
Actual results depend on numerous individual factors.
11. Calorie and nutritional information
Calorie, macronutrient and other nutritional information may be based on:
- calculations,
- databases,
- manufacturer information,
- AI estimates, or
- user input.
These values may deviate from the actual values of a food or a meal.
Yemevo can therefore not guarantee absolute accuracy of all calorie or nutritional information.
12. Meal Scan
With Meal Scan you can have a photo of a meal analysed.
The analysis attempts in particular to determine foods, ingredients and estimated calorie and nutritional information.
Meal Scan is an automated estimate.
In particular:
- foods may be recognised incorrectly,
- portion sizes may be estimated incorrectly,
- ingredients may not be recognised, or
- calories and nutritional values may be calculated incorrectly.
Where the respective app version allows it, you can correct recognisable errors.
Meal Scan does not replace professional food analysis or any binding allergen check.
13. Open Food Facts and external product information
For barcode and food information, Yemevo may use external data sources such as Open Food Facts.
Such product information is provided by third parties.
Yemevo cannot guarantee that all externally provided product information is at all times:
- complete,
- up to date, or
- free of errors.
In the event of discrepancies, the information on the actual product packaging and the manufacturer's information are decisive.
14. Metabolic Twin
The Metabolic Twin is a lifestyle simulation.
Based on user input and assumed scenarios, the feature can present estimated developments.
For example, it can simulate how a change to certain:
- calorie values,
- activity values,
- steps, or
- weight target parameters
might affect a possible development.
This is a model-based estimate.
The development presented is neither a guarantee nor a medical prognosis.
Actual results may deviate considerably from the simulation presented.
15. Voice features
Yemevo may use voice input in order to simplify certain entries.
Automated speech recognition and AI interpretation may be erroneous.
You should therefore check, particularly for relevant information, whether the recognised information was adopted correctly.
16. Free and paid plans
Yemevo may offer in particular the following plan tiers:
- FREE
- PRO
The precise scope of features of the individual plans may change over the course of product development.
Before a paid subscription is concluded, you will be shown the following information relevant to the respective plan:
- services,
- limitations,
- price,
- billing interval, and
- where applicable, trial conditions.
The service description presented before the contract is concluded is decisive for the respective subscription.
17. Prices
The prices applicable at the time are shown before the paid subscription is concluded.
Where legally required, total prices including applicable taxes are presented to consumers.
Yemevo therefore does not need to specify permanently fixed plan prices in these Terms.
Depending on:
- country,
- currency,
- platform,
- billing period,
- promotion, or
- distribution channel,
different prices may be offered.
The price applicable to you is shown before you conclude a purchase subject to payment.
18. Monthly and annual subscriptions
Paid Yemevo subscriptions may be offered in particular as:
- a monthly subscription, or
- an annual subscription.
The respective billing period is shown before the contract is concluded.
Unless cancelled before expiry, the subscription will in principle renew automatically for the further billing period indicated.
Automatic renewal is pointed out before the contract is concluded.
19. Free trial period
For certain paid plans, Yemevo may offer a free trial period (“trial”).
Whether a trial is available and how long it lasts is shown before activation.
If a subsequent paid subscription is already agreed when the trial is activated, the trial will automatically convert into the selected paid subscription at its end, unless it is cancelled in good time before the end of the trial.
The applicable price and billing period are shown before activation.
If you cancel in good time within the trial, no future subscription fees arise, unless something different was clearly indicated before conclusion.
20. Payment processing
The available payment methods are shown to you before the contract is concluded.
Depending on platform, region and distribution channel, payments may in particular be processed via:
- Stripe,
- Apple Pay,
- Google Pay,
- Apple or the App Store,
- Google or Google Play, or
- further payment methods expressly indicated.
When external payment providers are used, their respective payment and usage terms apply in addition.
When payment is made via a payment service provider, Yemevo does not, as a rule, receive your complete credit card details.
21. Conclusion of contract
For free features, the usage contract is in principle concluded upon successful registration or activation of the respective service.
For paid subscriptions, the contract is concluded when:
- you select a paid plan,
- the essential service and price information is shown to you before conclusion,
- you expressly confirm the purchase subject to payment, and
- the order or payment is successfully accepted.
The specific technical processing may differ depending on the platform or payment method used.
22. Cancelling a subscription
A paid subscription can in principle be cancelled at any time with effect from the end of the current billing period.
After cancellation, the paid plan generally remains usable until the end of the billing period already paid for.
Cancellation takes place via the respective management channel through which the subscription is managed.
This may in particular be:
- the Yemevo subscription area,
- the Stripe Customer Portal,
- Apple / the App Store, or
- Google Play.
Which cancellation route applies to your subscription depends on the specific payment and distribution channel.
Important
Merely deleting or uninstalling the Yemevo app does not automatically end an existing paid subscription.
In the case of a complete account deletion, Yemevo attempts to end subscriptions managed directly via Yemevo as part of the technical deletion process. However, where a subscription is managed by an external platform provider, additional cancellation with that provider may be required.
23. Refunds
For a billing period that has already begun and been paid for, there is in principle no voluntary pro-rata refund solely because Yemevo is no longer used during that period or the subscription was cancelled early.
This applies expressly only insofar as none of the following provide otherwise:
- a statutory right of withdrawal,
- statutory warranty rights,
- other mandatory consumer rights, or
- mandatory refund rules of the payment or platform provider used.
Mandatory statutory claims are not restricted by this provision.
24. Statutory right of withdrawal for consumers
For contracts concluded at a distance, consumers generally have the statutory right to withdraw from the contract within 14 days without giving reasons.
For service contracts, the withdrawal period generally begins on the day the contract is concluded.
The details of the statutory right of withdrawal and corresponding withdrawal instructions are made available to the user, where required, before or in connection with the conclusion of the contract.
If you expressly request that a paid service begin during the withdrawal period, a statutory pro-rata amount may be payable for the service properly provided up to that point in the event of a later withdrawal.
A statutory right of withdrawal lapses only under the conditions provided for by law.
These Terms do not restrict any mandatory statutory rights of withdrawal.
25. Warranty for digital services
For paid digital services, the mandatory statutory warranty provisions apply, in particular the provisions of the Austrian Consumer Warranty Act (Verbrauchergewährleistungsgesetz, “VGG”), insofar as it is applicable.
Yemevo provides necessary updates insofar as this is required under the applicable statutory provisions.
Statutory rights arising from a digital service not being in conformity with the contract are neither excluded nor restricted by these Terms.
26. Updates and technical changes
Yemevo is continuously developed further.
In particular, we may:
- fix errors,
- improve security measures,
- change user interfaces,
- replace technical components,
- optimise features,
- ensure compatibility with operating systems, or
- carry out legally necessary changes.
Necessary updates may arise in particular due to:
- security requirements,
- changes to iOS or Android,
- changes to APIs or third-party providers,
- technical developments, or
- legal requirements.
Users should install provided updates to a reasonable extent insofar as these are necessary for the secure and contractually compliant operation of the app.
27. Changes to an ongoing digital service
For digital services provided on a continuous basis, Yemevo may change the service beyond necessary security and conformity updates where there is an objective reason for doing so.
Such reasons may in particular be:
- technical developments,
- improvement or further development of features,
- security requirements,
- prevention of misuse or fraud,
- changes to operating systems or technical interfaces,
- changes to third-party providers used,
- adjustments due to legal or regulatory requirements, or
- the necessary further development of the technical infrastructure.
Such changes are made at no additional cost for the existing contract period.
We provide information about relevant changes in a clear and comprehensible form.
Insofar as a change impairs access to or use of a continuous digital service other than negligibly, the consumer's statutory information and contract-termination rights remain unaffected.
28. Changes to plans and prices
Yemevo may change prices for future contract or billing periods.
Price changes do not apply retroactively to billing periods already paid for in full.
Information about relevant price changes to ongoing subscriptions is provided in accordance with statutory requirements and the rules of the payment or platform provider used.
Insofar as consent is required in order to continue the subscription, such consent will be obtained accordingly.
29. Availability
We endeavour to ensure high availability of Yemevo.
However, availability at all times, uninterrupted and free of errors, cannot be technically guaranteed.
Temporary restrictions may arise in particular from:
- maintenance work,
- security updates,
- technical faults,
- internet or network outages,
- failures of cloud infrastructure,
- disruptions at external providers, or
- events outside our reasonable control.
Mandatory statutory claims arising from the failure to supply or from a defect in a digital service remain unaffected.
30. Third-party providers
Certain Yemevo features depend on services provided by external providers.
These may include in particular:
- OpenAI,
- Amazon Web Services,
- Firebase / Google,
- Apple,
- Stripe, and
- Open Food Facts.
Insofar as Yemevo is legally responsible for the proper provision of a contractually owed service, that responsibility is not excluded by involving a third-party provider.
For independent third-party services, their own terms of use may apply in addition.
31. Permitted use
Yemevo may only be used within the scope of the intended private and lawful use.
The following are not permitted in particular:
- abusive or unlawful use,
- attacks on systems or security mechanisms,
- circumventing usage limits or access restrictions,
- automated scraping without our consent,
- unauthorised reverse engineering, insofar as this is not expressly permitted by law,
- distribution of malware,
- use of other persons' user accounts without authorisation,
- attempts to impair Yemevo's technical infrastructure.
32. User content
Insofar as you provide Yemevo with content such as:
- texts,
- images,
- meal photos, or
- voice input,
you confirm that you are entitled to use that content.
You grant Yemevo the rights necessary for the technical provision of the feature you have requested, insofar as this is necessary for:
- upload,
- processing,
- analysis,
- temporary storage, and
- output of the result.
Any use beyond that takes place only insofar as this has been expressly agreed or is permitted by law.
33. Data protection
The processing of personal data is described separately in the Yemevo Privacy Policy.
The Privacy Policy is not part of a blanket consent.
Insofar as consent is required for certain processing operations, for example for:
- sensitive nutrition information, or
- certain AI personalisation features,
such consent is obtained separately.
34. Intellectual property
Unless stated otherwise, all rights in:
- Yemevo,
- software,
- design,
- user interfaces,
- logos,
- trade marks,
- database structures,
- our own texts, and
- other protected content
belong to Monadion GmbH or the respective licensors.
For the duration of your usage relationship, you are granted a personal, non-exclusive and non-transferable right to use Yemevo for the intended private purposes.
Any use beyond that requires our consent, insofar as it is not permitted by law.
35. Blocking and restricting an account
We may temporarily restrict or block a user account where there are specific indications of:
- substantial breaches of these Terms,
- fraudulent use,
- security risks,
- abusive use,
- attacks on Yemevo or other users, or
- measures required by law.
Insofar as possible and reasonable, we inform the affected user about the measure and give them the opportunity to clarify the matter.
Mandatory consumer rights remain unaffected.
36. Account deletion
You can delete your Yemevo account using the feature provided for that purpose.
Deleting your account generally ends your ability to access stored personal content and data of the account.
Before deletion you should, if desired, use the available data export feature.
The treatment of any paid subscriptions still in place is governed by section 22 of these Terms.
Statutory retention obligations remain unaffected by an account deletion.
37. Liability
The statutory provisions apply to the liability of Monadion GmbH.
In particular, these Terms neither exclude nor restrict mandatory statutory claims.
This applies in particular to claims arising from:
- personal injury,
- intentional or grossly negligent conduct,
- mandatory warranty rights,
- product liability, or
- other mandatory statutory grounds of liability.
The notices in these Terms regarding AI estimates, Meal Scan, calorie values, Metabolic Twin and external product information describe the technical and substantive nature of these features and do not constitute an exclusion of mandatory statutory liability.
38. Contract duration
The free usage contract exists for an indefinite period in principle and can be ended by deleting the user account.
Paid subscriptions exist for the respective agreed:
- monthly, or
- annual
billing period and renew in accordance with section 18 unless they are cancelled in good time.
39. Changes to these Terms
We may change these Terms where there is an objective reason for doing so, in particular due to:
- changes in the law,
- new or changed product features,
- technical developments,
- security requirements, or
- changes to the business model.
Changes must not circumvent mandatory statutory rights of existing users.
We provide information about material changes in an appropriate form.
Insofar as the express consent of the user is required for a change under the applicable law, such consent will be obtained.
The version of the Terms applicable at the time is made available via Yemevo or via the website linked from Yemevo.
40. Applicable law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, insofar as no mandatory statutory provisions preclude this.
For consumers whose habitual residence is in another state, this choice of law does not result in them being deprived of the protection of mandatory provisions of the law that would apply to the contract in the absence of the choice of law.
41. Place of jurisdiction
The statutory rules on jurisdiction apply to disputes.
In relation to consumers, these Terms do not agree any place of jurisdiction deviating from mandatory statutory consumer jurisdictions.
42. Invalidity of individual provisions
Should a provision of these Terms be wholly or partly invalid or unenforceable, the applicable statutory rules apply in its place.
The validity of the remaining provisions remains unaffected to the extent permitted by law.
